The present writ petition has been filed alleging that the petitioner was initially appointed on account of vacancy of one Shri Angad Singh, who died in the year 1991 and as such the petitioner was promoted as Officiating/Ad-hoc, Principal on 18.02.1991 and on account of promotion of Shri Bhagwan Singh, a short term vacancy occurred which was advertised in the newspaper and on an application of the petitioner, the petitioner was appointed vide order dated 01.07.1992. As no financial approval was granted, as such, the petitioner filed Writ Petition No.43865 of 1997 which was disposed on 23.12.1997 directing the DIOS to decide the claim of the petitioner. The petitioner claims to have submitted a representation in terms of the order dated 23.12.1997 on which an order was passed on 31.05.1998 whereby the appointment of the petitioner was approved with effect from January,1998. The said approval order is on record as Annexure No.6 to the writ petition. The petitioner continued his services since 06.07.1992, as such, he claimed regularization of the services. The said application was forwarded by the DIOS to Regional Joint Director of Education Allahabad. The petitioner claims that in the letter dated 06.09.2016, it is clearly mentioned that the petitioner was appointed under Section 18 of the U.P. Secondary Education Services Commission (Removal of Difficulties) 1981. The petition has also brought on record vide letter dated 23.09.2016 wherein the Divisional Committee has recorded that the case of the petitioner cannot be considered for regularization.
