Heard learned counsel for the petitioners and the learned Standing Counsel.

Learned counsel for parties are ad idem that this petition shall merit disposal in terms of the order passed in Writ-A No. 5220 of 2016 [Kishore Kumar Constable And 13 Others v. State of U.P. & Another] . That petition was disposed of in the following terms: -

"Heard Sri Kailash Pandey, learned counsel for the petitioners and Sri Amar Nath Singh, learned standing counsel for the respondents.

The petitioners are demanding House Rent Allowance pursuant to the Government Orders dated 8.12.2008 and 11.6.1999. It is stated that the petitioners are living in private accommodation/rented houses with their family and they have not been allotted official accommodation. As per the Government Order, the employees who have not been allotted official quarter and are residing in private quarters or rented houses are entitled for House Rent Allowance.

Learned Standing Counsel submits that the claim of the petitioners can be considered by the competent authority, hence, this writ petition is being disposed of with a direction to the respondent no.2, Senior Superintendent of Police, District Kanpur Nagar to decide the claim of the petitioners regarding payment of House Rent Allowance within the period of two months from the date of production of certified copy of this order.

The petitioners may make fresh representation before the competent authority along with the copy of this order.

The writ petition is disposed of as such."

Accordingly, the respondent No. 2 shall consider and dispose of the claim of the petitioner for grant of House Rent Allowance in terms of the aforesaid order. All contentions of respective parties on merits are kept open.
