Heard learned counsel for the petitioner, Sri Jagannath Maurya who appears for the respondent Nos. 2 to 4 and the learned Standing Counsel for the State.
The principal grievance which is raised in this petition is in respect of non payment of subsistence allowance pending disciplinary proceedings which have been initiated against the petitioner by the Corporation.
Although the petitioner was suspended on 16 January 2019, undisputedly the disciplinary proceedings have not yet been completed.
According to Sri Maurya learned counsel appearing for the Corporation, the proceedings have lingered since the petitioner has not responded to the charge sheet as well as the supplementary charge sheet which was served upon him as far back as in January 2019.
Sri Maurya however on instructions states that subject to the petitioner cooperating in the enquiry proceedings and not taking any unnecessary adjournments, all endeavour shall be made to conclude the same expeditiously and preferably within a period of three months from today. He further submits that the claim of the petitioner of alleged non payment of subsistence allowance will also be duly considered and an order in respect of that communicated to the petitioner within a period of two weeks from today.
The statement so made is recorded and accepted. All contentions of respective parties on merits is left open.
The petition stands disposed of in the above terms.
