Heard learned counsel for the petitioner, Sri Abhishek Srivastava who appears for the contesting respondents and the learned Standing Counsel for the State respondent.
The essentiality of possessing a CCC certificate issued by NIELIT in the recruitment exercise which was initiated by the respondents was upheld by the Court in its judgment rendered in Prashant Kumar Jaiswal v. State of U.P. and Others [2018 (2) ADJ 633] . The said judgment has since then been affirmed by the Supreme Court on 16 December 2019 in Civil Appeal No. 9026 of 2019 [Mukul Kumar Tyagi v. State of U.P. And Others] . The candidature and selection of the petitioner was cancelled by the respondents by an order of 21 June 2018 in terms of the exercise required to be undertaken in terms of the directions issued in the two decisions aforementioned. That order has attained finality since it was never assailed by the petitioner. Consequently the writs of mandamus as prayed for in the instant petition cannot be granted.
The petition is dismissed .
