Heard Sri Praveen Kumar Singh, learned counsel for the petitioner, learned Standing Counsel for the contesting respondents.

By means of this petition under Article 226 of the Constitution, the petitioner has made following substantial relief:

"a. Issue a writ, order or direction in the nature of mandamus commanding/ directing the respondent no. 2 District Magistrate, Kanpur Nagar to release the pensionary benefits, gratuity fund and other admissible allowances since 31.03.2016 i.e. from the date of retirement and further to pay pensionary benefit month to month whenever it falls due of the petitioner."

It transpires from the record that the petitioner has already represented the matter before the competent authority to give his post retirement dues while he worked as Lekhpal and thereafter, promoted and retired from the post of Registrar, Kanoongo from Ghatampur, Kanpur Nagar.

Without entering into the merits of the claim of the petitioner, the writ petition at this stage is disposed of with a direction to the District Magistrate, Kanpur Nagar to look into and consider the grievance of the petitioner for post retirement dues and if he is otherwise found to be eligible, release all the retirement dues within a period of two months from the date of production of copy of this order. Needless to add that the order should be reasoned and speaking one.

The copy of the order available on official website of this Court shall be treated to be genuine one, however, as and when the certified copy of the order is issued, the same shall also be submitted before the competent authority.
