It is alleged that Plot No. 565, which is recorded as Chak Marg, has been encroached upon by the private respondents and despite such facts having been brought to the notice of the competent authority, no action is being taken in terms of Section 67 of the U.P. Revenue Code, 2006. Copy of the application filed before the competent authority is Annexure 3 to the writ petition.

Learned Standing Counsel for the respondent nos. 1 to 3 as well as Sri Bhupendra Kumar Tripathi, learned counsel for the respondent no. 4 - Gaon Sabha states that an appropriate decision will be taken by the competent authority.

Considering the nature of order proposed to be passed, notices need not be issued to respondent nos. 5, 6 & 7 and the writ petition is being disposed of at this stage itself after hearing the learned counsel for the petitioner and the learned Standing Counsel for the respondent nos. 1 to 3 as well as Sri Bhupendra Kumar Tripathi, learned counsel for the Gaon Sabha.

In that view of the matter, this writ petition stands disposed of with a direction upon the second respondent to examine petitioner's grievance with reference to the provisions contained under Section 67 of the U.P. Revenue Code 2006 after affording an opportunity of hearing to the respondent nos. 5, 6 & 7, by passing necessary orders in accordance with law, within a period of four months from the date of presentation of a copy of this order before him.

The concerned Authority/Official shall verify the authenticity of computerized copy of this order from the official website of High Court Allahabad and shall act accordingly without waiting for submission of the certified copy of this order.
