The case of the petitioner is that they have married of their free will, according to the Hindu rites, on 27.06.2019, at the Arya Samaj Mandir, Gokhale Market Trust, Gokhale Market, Tis Hazari, Delhi. The first petitioner has been detained and confined unlawfully by respondent no. 4, against her will and wish. It is the petitioner's further case that the first petitioner is a major, her date of birth being 13.10.1997. She is free to stay with a man of her choice and whomsoever she likes. Before this Court, a birth certificate issued by Nagar Nigam, Agra, has been produced in original, a copy of which is annexed as Annexure No. 2, which shows the first petitioner's date of birth to be 27.09.1998. Going by the said age, she is a major. It appears from a perusal of the bail order in Case Crime No. 551 of 2019, under Sections 363, 366, 376, 12B, 504, 506 I.P.C. and Section 5tra(2)/6 POCSO Act, Police Station - Sikandra, District - Agra passed by this Court on 19.12.2019 in Criminal Misc. Bail Application No. 50278 of 2019, in favour of the second petitioner, Sagar, that the first petitioner has been medically examined and found to be 19 years. It is on that basis that bail was granted to the second petitioner in the crime registered at the instance of the fourth respondent.
