Heard Sri Gauri Shankar Yadav, learned counsel for the petitioner and the learned A.G.A.

This writ petition has been filed by the petitioner to issue a writ, order or direction in the nature of certiorari quashing the impugned FIR dated 27.3.2016, registered as Case Crime No.383/2016, under Sections 419/420/467/468/471 IPC, P.S. Kotwali City, Mirzapur.

The allegation against the petitioner is that she obtained forged graduation B.Ed. and B.A. degree from Dr Bhimrao Ambedkar University, Agra, but she did not obtain any public employment on the basis of said documents.

Learned AGA opposed the submission on the premise that prima facie a cognizable offence is made out, no interference is required to be made.

We are of the considered view that ends of justice would be served if this petition is disposed of with the direction that no arrest of the petitioner shall be effected unless the degree in question on verification is found to be forged.

We further clarify that above verification would be by an officer not below the rank of Superintendent of Police and that we have not stayed the ongoing investigation.

With the aforesaid direction, this petition is finally disposed of.

The party shall file a computer generated copy of this order downloaded from the official website of High Court Allahabad, self attested by the petitioner / s alongwith a self attested identity proof of the said person (s) (preferably Aadhar Card).
