Heard learned counsel for the petitioners and learned A.G.A. for the respondents.

The petition has been filed for quashing of the first information report dated 25.01.2020, registered as Case Crime No. 21 of 2020, under Section 366 I.P.C., Police Station Naugawa Sadat, District Jyotiba Phule Nagar (Amroha).

The first information report has been lodged by respondent no. 4 who is father of petitioner no. 2 i.e. Rajani. The submission is that petitioner no. 2 is a major and she has married petitioner no. 1 for her own free will. The certificate of the registration of marriage is on record. The said petitioner no. 2 has also filed affidavit in support of this petition and alleges that she has married petitioner no. 1 of her own free will without any outside pressure.

In view of the aforesaid facts and circumstances, though the matter requires investigation and it is not desirable to quash the first information report, we dispose of the writ petition with direction that the petitioners shall not be arrested in pursuance to the impugned first information report till the submission of the report under Section 173(2) Cr.P.C., provided the petitioners cooperate and participate in the investigation, which shall be completed most expeditiously.
