Sri Pravin Kumar Misra, learned counsel for the petitioners at the very out set submits that the writ petition be dismissed as not pressed.
Learned counsel for the respondent no.3 and learned A.G.A. for the State points out that previously one more petition being Criminal Misc. Writ Petition No.168 of 2020 (Dr. Ashrfi Lal and 5 others Vs. State of U.P. and 3 others) was filed for the quashing of the same FIR and the same was disposed of vide order dated 13.1.2020.
Counsel for the petitioners accepts that the earlier petition was filed but the petitioners were not aware on it and it is for this reason that he has made a request for withdrawal of the writ petition.
In view of the above fact and that successive petitions for the same cause of action are not maintainable, the writ petition is dismissed as withdrawn .
