Instant appeal has been preferred by the appellant against the judgement and order dated 26.10.1985 passed by the Sessions Judge, Budaun in S.T. N no. 395 of 1983 convicting the appellant under Section 325/34 I.P.C.
Vide order dated 17.3.1986, the present appeal was admitted and notices were directed to be issued. Simultaneously, the sole appellant was enlarged on bail.
Vide order dated 13.2.2020, Joint Registrar (J)(Crl.) has issued notice to the appellant, to appear before the Court. In pursuance of the aforesaid order, the Chief Judicial Magistrate, Budaun has submitted a report dated 15.1.2020 informing that the sole appellant had died. To verify the factum of death of the appellant, he has recorded the statement of Abdul Muhid, son of the appellant and two other residents of the village. The statements of the aforesaid persons and the death certificate issued by the Gram Pradhan are appended with the report of the Chief Judicial Magistrate.
