Heard Sri Aklank Kumar Jain, learned counsel for the applicant and the learned AGA for the State.

The present application under Section 482 Cr.P.C. has been preferred seeking a direction upon the Court below for early disposal of Sessions Trial No.641 of 2003 (State v. Ramesh Chandra Upadhyay and others) under Sections 302 and 307 IPC, Police Station-Uttar, District-Firozabad.

Learned counsel for the applicant states that FIR was lodged on 24.10.1999 as Case Crime No.670 of 1999 under Section 302 and 307 IPC, Police Station-Uttar, District-Firozabad. Thereafter, case was committed to Sessions Court vide order dated 13.11.2003 and charges were framed by the Sessions Court on 01.07.2004. It is submitted that at present proceedings of the case is at the stage of evidence. Last prosecution witness was examined on 21.04.2006 and since then present matter had remained throughout pending with no other fruitful action. Accused/O.P. no.2 to 5 had throughout tried to get the matter adjourned on one pretext or another.

Taking into consideration the aforesaid fact, learned Court below is hereby directed to make serious endeavour to expedite the trial and conclude the same expeditiously,

preferably within one year from the date of production of a certified copy of this order. It is further directed that Court below shall fix short dates and shall not grant any unnecessary adjournments to either of the parties.

With the aforesaid observations, present application is finally disposed of.
