It is submitted by the learned counsel for the appellant that the appellant is innocent and has been falsely implicated in this case; he has not committed the present offence; the appellant is student of B.SC.-Ist year; alleged offences are not attracted against him; earlier the victim/deceased lodged the F.I.R. against one Rohit Tiwari as Case Crime No. 20 of 2018, under Sections 452, 376, 308, 323, 504, 506 I.P.C. and Section 3 (2) (5) of SC/ST Act, P.S. Rajapur, District Chitrakoot in which Sessions Trial no. 03 of 2019 is pending before the Additional Sessions Judge, Chitrakoot. He further submits that victim/deceased committed suicide due to frustration; the appellant had no relationship with the victim/deceased; due to prior enmity of the appellant with the in-laws of the deceased, the appellant has been implicated in this case; the matter was investigated but no evidence, such as photographs and letter, has been collected against the appellant; no specific role has been assigned to him. The appellant has no criminal history, he is in jail since 23.01.2020 and in case he is released on bail he will not misuse the liberty of bail. It is lastly submitted that the impugned order rejecting the bail application of the appellant suffers from infirmity and illegality warranting interference by this Court.
