Learned counsel for the applicant submits that allegations made in the F.I.R. are totally false and fabricated; victim is a married woman, aged about 36 years, having four children; the statements recorded under Sections 161 and 164 Cr.P.C. are contradictory and are not corroborating the facts stated in the F.I.R. and medical; on perusal of the F.I.R. and the statement under Section 164 Cr.P.C., it appears that the victim was consenting party and only to pressurize the applicant to get married with him, present F.I.R. has been lodged. Moreover, there is no prospect of trial of the present case being concluded in near future due to heavy dockets. It is next submitted that there is no possibility of fleeing away of the applicant from the judicial custody or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. It is also contended that the applicant is languishing in jail since 15.06.2020.
