This bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant, Panna Lal @ Pintu @ Pramod , seeking enlargement on bail during trial in connection with Case Crime No. 49 of 2019, under Sections 324, 504, 506, 308 I.P.C., registered at P.S. Bagwala, District Etah.
Learned counsel for the applicant argued that in the F.I.R general role has been assigned to the applicant. The applicant had no motive at all to commit the aforesaid offence. There was a family dispute between the parties in which the present incident as alleged has happened. The applicant having no criminal history is in jail since 04.01.2020.
Per contra learned A.G.A and learned counsel for the first informant vehemently opposed the prayer for bail and argued that in the statement of the injured (Ram Veer Singh) the applicant has been assigned the role of assaulting him with a pharsa . The C.T. scan report shows Hematoma present beneath the injuries. The role assigned to the applicant corroborates with the injuries as received.
