Heard Sri Ajay Kumar Srivastava, learned counsel for the applicant, learned A.G.A. and perused the material on record.
This bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant Tejram seeking enlargement on bail during trial in connection with Case Crime No. 292 of 2019, under Sections 201 IPC, registered at P.S. Jahanabad, District Pilibhit.
Learned counsel for the applicant argued that the applicant is father-in-law of the deceased. Initially the First Information Report was registered under Sections 302, 201 IPC but after investigation the police submitted charge sheet under Section 302, 201 IPC against Banwari Lal (the husband) and further under Section 201 IPC only against the applicant (father-inlaw), Jitendra (devar) and Om Prakash (devar). So far as the applicant is concerned, no charge sheet under Section 302 IPC has been submitted against him. The applicant is in jail since 30.10.2019 having no criminal history.
Per contra, learned AGA opposed the prayer for bail.
