This is a second application for bail. The first bail application being Criminal Misc. Bail Application No.36693 of 2018 was rejected by this Court by an order dated 15.07.2019. Heard learned counsel for the applicant and the learned A.G.A.
This is a bail application on behalf of the applicant Ravindra Nagar in connection with Case Crime No.0364 of 2018, under Sections 307, 323 and 504 I.P.C., Police Station Civil Lines, district Meerut.
The first information report of this incident was lodged by the Chef Medical Officer, Meerut against his own driver with the allegation that on 05.07.2018 at about 7.00 p.m. when the meeting of Provincial Medical Services Association was going on and when the meeting was concluded then Dr. Chandan Prakash, who was posted as Medical Officer, Hastinapur reached at the main door of the office of the Chief Medical Officer then Manish Sharma along with others started quarreling with Dr. Chandan Prakash and started abusing him and other doctors present there. When Manish Sharma was abusing the doctors then the applicant came there and he also started abusing Dr. Chandan Prakash and other doctors and started marpit with him and when Dr. Chandan Prakash tried to save himself, the applicant fired at Dr. Chandan Prakash and the bullet hit Dr. Chandan Prakash in his chest and he fell down. Dr. Chandan Prakash has narrated the entire incident to the complainant and other doctors present there.
The submission of learned counsel for the applicant is that the applicant is quite innocent and has been falsely implicated in the present case with the ulterior motive. He submitted that the trial has not yet been started and there is no any other fresh ground for consideration of bail. He
submitted that the applicant is in jail since 06.07.2018.
Learned A.G.A. has opposed the bail plea and has submitted that the applicant has committed a gruesome act against his superior officer and his act has shaken the conscience of the society. He submitted that the Chief Medical Officer, Meerut himself has lodged the first information report against his own driver. He further submitted that the injured was kept on ventilator to sustain his life for long time.
Considering the overall facts and circumstances, the nature of allegations, the gravity of offence, the severity of the punishment, the evidence appearing against the accused, but without expressing any opinion on merits, this Court does not find it to be a fit case for bail.
Accordingly, the second bail application stands rejected with a direction to the court below that the trial of the aforesaid case be expedited and positively be concluded within one year from the date of production of the copy of this order and the trial court will not grant any unnecessary adjournment to any of the parties.
The party shall file computer generated copy of such order downloaded from the official website of High Court Allahabad, self attested by the learned counsel for the applicant alongwith a self attested identity prof of the said persons (preferably Aadhar Card) mentioning the mobile number (s) to which the said Aadhar Card is linked before the concerned Court/Authority/Official.
The concerned Court/Authority/Official shall verify the authenticity of such computerized copy of the order from the official website of High Court Allahabad and shall make a declaration of such verification in writing.
