alleged incident has occurred. The learned counsel further submits that for the first time the allegation of rape has surfaced in the statement of the prosecutrix in her statement recorded under Section 161 Cr.P.C.. It is further contended that the allegation of rape has been levelled on coaccused Deepak in her statement recorded under Section 161 Cr.P.C. and the present accused was assigned the role of helping co-accused Deepak in committing rape. The learned counsel has further argued that the prosecutrix has not supported the version of rape in her statement recorded under Section 164 Cr.P.C., which is annexed at page No. 33 of the Paper Book and she has stated in her statement recorded under Section 164 Cr.P.c. that the victim's mother was having relations with the present accused and co-accused Deepak was residing in front of the residence of the present accused Poonam and he has taken Rs. 20,000/- as loan from the mother of the victim and victim's family was demanding the money from the coaccused Deepak, he was not repaying the money. That is why they have lodged the First Information Report. It has been mentioned in her statement recorded under Section 164 Cr.P.C. that no mar-pit took place between the prosecutrix and accused persons. Lastly, it is argued that the applicant is in jail since 24.05.2020 and that in case she is enlarged on bail, she will not misuse the liberty of bail.
