Learned counsel for the applicant argued that the present case is a cross case in which an attempt was made for lodging the First Information Report by the applicant which could not successful hence an application under Section 156(3) Cr.P.C. was moved. Even after an order by the court concerned on the application under Section 156(3) Cr.P.C., the First Information Report was not registered and hence the informant is filed writ petition before this Court being Crl. Misc. Writ Petition No. 18821 of 2019 (Drag Pal Vs. State of U.P and 3 others), in which, a Division Bench vide order dated 11.07.2019 referred to the arguments and called for instructions by the learned A.G.A. as to why the First Information Report has not been registered till date in pursuance of the order dated 04.05.2019 passed by the Chief Judicial Magistrate, Hamirpur. It is argued that after an order was passed by the Division Bench on 11.07.2019, the First Information Report was lodged on 14.07.2019 as Case Crime No. 0058 of 2019 P.S.- Chikasi, District Hamirpur, copies of the order of the Division Bench and the First Information Report are annexed as annexure nos. 7 and 8 to the affidavit respectively. It is further argued that the applicant received injuries which are annexed as annexure no. 1 to the affidavit being present on the vital part of the body which cannot be self inflicted.
