This bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant, Megh Singh, seeking enlargement on bail during trial in connection with Case Crime No. 170 of 2019, under Sections 394, 411, 302 I.P.C., registered at P.S. Bah, District Agra.
Learned counsel for the applicant argues that the co-accused (Neelam @ Chapta) has been granted bail by another Bench of this Court vide order dated 07.12.2019 passed in Criminal Misc. Bail Application No.54338 of 2019. A copy of the order is Annexure- 10 to the affidavit. The role of the accused applicant is identical to that of co-accused who has been granted bail. The recovery as affected from the pointing out of the applicant is not trustworthy. The applicant is in jail since 16.06.2019 having no criminal history.
Per contra learned A.G.A opposed the prayer for bail but could not dispute the fact the arguments raised by the learned counsel for the applicant.
