co-accused, who has been granted bail. First information report of the incident was lodged against seven persons wherein it was mentioned that on 05.07.2019 when the father of the first informant had gone to the field to cut the green grass for the goats then the accused persons, who were sitting there, committed marpeet with lathi and danda and they also fired in the air with their firearms. The incident is alleged to have taken place on 05.07.2019 at about 7.00 A.M. but first information report was lodged on the same day at 14.12 hours. The distance between the place of occurrence and police station is 16 kilometers. He further argues that there is unexplained delay in lodging the first information report. There are general allegations levelled against all the accused persons for assaulting Keshav Das, the deceased. The injury nos.8 and 10 as noted in the post mortem examination report are incised wounds without any explanation whatsoever. Since the incident as detailed in the first information report and even mentioned in the statement under Section 161 Cr.P.C. of the first informant, there is a specific and clear version of the use of lathi and danda but still two incised wounds as received have not been explained at all. It is further stated that there is no recovery of any incriminating material either from the possession or pointing out of the applicant. He further argued that the applicant is in jail since 04.08.2019 and has no criminal antecedents as mentioned in para 27 of the affidavit, therefore, he be released on bail.
