Contention raised by learned counsel for the applicant is that the F.I.R. was got registered by Shri Samar Bahadur Yadav, S.O. on 4.10.2017 under Sections 286, 304, 308, 427 I.P.C. and Section 3/4/5 of The Explosive Substances Act against as many as 11 named accused persons including the applicant attributing a general and omnibus role to every named accused persons. It is further contended that the trial is in progress and P.W.-1, S.O. Samar Bahadur Yadav in his testimony has clearly indicated that there is no involvement of applicant in the commission of crime, nor there is any recovery of any incriminating material from the possession of the applicant. It is further submitted that out of named accused persons, Amir and Ayaz were admitted on bail by Coordinate Benches of this Court while deciding Criminal Misc. Bail Application Nos.6084/2018 and 11137/2020 on 4.3.2020 and 16.6.2020 respectively. Contention is that the case of the applicant stands on similar footing qua the aforesaid co-accused who have been admitted on bail, therefore, on the principles of parity the applicant may also be released on bail. The applicant is in jail since 10.10.2020 having no criminal antecedents.
