This bail application under Section 439 of Code of Criminal Procedure has been filed by the applicant, Rahul Singh Rajpoot, seeking enlargement on bail during trial in connection with Case Crime No. 100 of 2019, under Sections 147, 148, 149, 120-B, 302, 34 I.P.C. and 7 Criminal Law Amendment Act, registered at P.S. Shivpur, District Varanasi.
The F.I.R in the present incident was registered on 25.02.2019 at about 03:48 a.m. for an incident alleged to have taken place on 24.02.2019 at about 21:30 hrs by Randheer Singh @ Rana in which he has stated that he had gone on 24.02.2019 along with his brother Akhilesh and elder son Abhishek Singh to meet his younger son Vivek Singh at Uday Pratap College, Varanasi. His son Vivek Singh who is the deceased in the present matter was living in room no. 10 in the hostel along with his friend Pankaj Singh Bagi. After they met Vivek Singh and started proceeding to the house of his brother Akhilesh, Vivek and his friend Pankaj Singh Bagi came out to see them of and as soon as they reached the gate of P.G. Hostel, Anupam Nagwansi @ Kundan, Ankit Singh Sengar, Rahul Rajput, Pawan Singh Chintu and 4-5 other boys were standing there wherein Anupam called his son and as soon as he reached there all the friends of Anupam exhorted to kill him and started indiscriminate firing upon him. On hearing the fire a lot of terror spread in the vicinity and there was a lot of disturbance at the place. The market was immediately closed down and the people started running here and there. When the firing stopped then the first informant along with his companions reached the gate of the hostel and found his son Vivek Singh lying on the floor.
