Heard learned counsel for the applicant, learned A.G.A. for the State and perused the entire record.
This is the second bail application on behalf of the applicant. His first bail application was dismissed as withdrawn, vide order dated 06.01.2020, passed by this Court.
The present bail application has been filed by the applicant in Case Crime No. 164 of 2018 under Sections 302, 120B, 34 of IPC, Police Station - Nagina Dehat, District - Bijnor with the prayer to enlarge the applicant on bail.
The first information report of this incident was lodged by the complainant against the murder of his daughter by the named accused Vishal who happens to be the husband of the deceased.
The contention as raised at the Bar by learned counsel for the applicant is that applicant-accused is quite innocent and he has been falsely implicated in the present case. Learned counsel has further submitted that five witnesses have been examined and trial has not yet been concluded by the Trial Court. The learned counsel also submits that the applicant is in jail since 05.12.2018 and in case of his being released from jail, he will not misuse the liberty of the bail.
