The instant bail application has been filed on behalf of the applicant, Ravindra Sharma, with a prayer to release him on bail in Case Crime No. 683 of 2018 C.N.R. No. U.P.B.R.01005787-2020 under Sections 420, 467, 468, 471 I.P.C., Police Station- Kotwali, District- Bareilly, during pendency of trial.
There is allegation in the F.I.R. regarding issuance of an appointment letter on the post of ward boy which was found to be a fabricated document. The F.I.R. has been lodged by the Chief Medical Officer, Bareilly against unknown persons.
Learned counsel for the applicant has submitted that the applicant has been falsely implicated in this case. He was not named in the F.I.R. He has been implicated on the basis of the statement of the witnesses recorded by the Investigating Officer. The applicant has no criminal history to his credit and is in jail since 28.07.2020.
Learned A.G.A. has opposed the prayer for bail of the applicant.
Having considered the material on record, larger mandate of the Article 21 of the Constitution of India and the dictum of Apex Court in the case of Dataram Singh Vs. State of U.P. and another, reported in (2018) 3 SCC 22 and without expressing any opinion on the merits of the case, let the applicant involved in the aforesaid crime be released on bail on his furnishing a personal bond and two sureties each in the like amount to the
satisfaction of the court concerned with the following conditions that :-
In case of breach of any of the above conditions, it shall be a ground for cancellation of bail.
