Learned counsel for the applicant submits that according to F.I.R. version before two and a half year from the date of incident informant married with the victim aged about 26 years and brought her from Orissa and it is alleged that on 04.06.2020 in the night at about 8:00 p.m. she went missing, regarding which a missing report was lodged, she came back on 07.06.2020 and told that Raj Bahadur son of Kampu, R/o Village Chichara and his friend Pappu son of Natthu resident of same village eloped her away and left after three-four days at the bus stand by motorcycle. He further submits that applicant is not resident of Chichara, he is resident of village Surha. It is also submitted that distance of village Chichara and Surha is near about 20 kilometers. The applicant has not committed the alleged offence. He has been falsely implicated in the present case. There is no possibility of the applicant of fleeing away from the judicial process or tampering with the witnesses and, in case, the applicant is enlarged on bail, the applicant shall not misuse the liberty of bail. It is next contended that the applicant is languishing in jail since 10.08.2020.
