Heard learned counsel for the applicant, Sri Sushil Kumar Dubey, learned counsel for the informant and learned AGA for the State.
The instant bail application has been filed on behalf of the applicant, Munshi Lal, with a prayer to release his on bail in Case Crime No. 02 of 2020, under Sections 498-A, 304-B I.P.C and 3/4 D.P. Act, Police Station Jaswant Nagar, District- Etawah during pendency of trial.
Submission is that the deceased entered into love marriage with son of the applicant. The applicant is the father-in-law of the deceased. There are general allegations of demand of dowry. It has been submitted by the learned counsel for the applicant that the deceased was suffering from unknown decease and was being treated for long time. Even in the post mortem cause of death has not been ascertained. Applicant alleges false implication in this case. The applicant is in jail since 03.01.2020. He has criminal history of one case under Sections 498-A, 323, 504, 506 I.P.C and 3/4 D.P. Act. It was regarding marriage of his other son. Supplementary affidavit has also been filed bringing on record order of acquittal of applicant in the aforesaid case.
Learned AGA has opposed the prayer for bail of the applicant.
