Learned counsel for the applicant submits that FIR has been lodged under Sections 354, 342, 328 and 506 IPC. As per FIR, on 17.09.2019 at 5.00 a.m. applicant and coaccused molested the victim and also fed some intoxicating medicine. After investigation charge sheet has been submitted under Sections 354, 342, 328, 506, 376D IPC and 3/4 POCSO Act. He further submits that applicant is uncle of the co-accused Om Prakash and applicant pressurized and threatened the victim to conduct marriage with the co-accused. He also submits that as per paper no.25, victim informed to the police station that applicant and co-accused molested her and threatened her. She refused to conduct her medical examination as well. He next submits that after two and half months of the incident statement of the victim under Section 164 Cr.P.C. has been recorded in which she has stated that the applicant an co-accused forcefully took away her in the open house and molested her, on raising alarm by the victim they put intoxicating medicine in her mouth and after tying her hands and legs they ran away. After 3-4 hours she gained consciousness, she saw that her clothes were off and rape was committed upon her and after two days she went to the police station.
