Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated in the present case due to enmity. He has committed no offence. Prosecution story is false and fake. As per FIR, five persons have been named along-with twenty five others who are said to have attacked upon the informant and other persons with lathi and danda causing serious injury to them. There is no specific role has been assigned to any of the accused. There is general role against all the accused persons. Statement of main victim Anil Kumar could not be recorded by the Police so far. Applicant is in jail since 29.11.2019 having no criminal history against him. It is further submitted that there is no possibility of the applicant's fleeing away from the judicial process or tampering with the witnesses. In case, the applicant is enlarged on bail, he shall not misuse the liberty of bail. It is further submitted that co-accused persons, namely, Bramhpal, Pushpendra Gautam and Kaushindra have already been granted bail on 31.10.2019, 01.11.2019 and 24.10.2019 in Criminal Misc. Bail Application Nos.43548 of 2019, 45671 of 2019 and 43510 of 2019 respectively.
