It is submitted by learned counsel for the applicant that in this case FIR was lodged on 13.11.2004. After submission of charge-sheet, charges were framed against the accused on 18.05.2018. It is further submitted that after framing of charge in the matter prosecution witnesses is not coming forward, therefore, effective proceedings in the trial is not going on. On perusal of the order-sheet filed by the applicant from 18.05.2018 to 06.01.2020, I find that on 12.06.2018, 13.07.2018, 1.8.2018, 30.08.2018, 25.09.2018, 15.10.2018, 14.11.2018, 04.01.2019, 08.02.2019, 05.03.2019, 09.04.2019, 3.05.2019, 06.06.2019, 23.08.2019, 01.10.2019, 21.10.2019 and 6.01.2020 either adjournment applications were moved by the prosecution witnesses or prosecution witness did not appear before the trial court. Order-sheet also shows that some of the accused persons of this case also moved adjournment application for exemption of their personal appearance. It is also submitted that earlier on account of pendency of Application under Section 482 Cr.P.C. No. 1455 of 2005 before this Court, the trial proceeding was not going on. The said application has been dismissed on 04.01.2017.
