Supplementary affidavit filed by learned counsel for the applicant is taken on record.

Heard Dr. S.B. Singh, learned counsel for the applicant, Sri Gyan Prakash, learned Senior Advocate assisted by Sri Sanjay Kumar Yadav, learned counsel appearing for the CBI as well as learned A.G.A. for the State.

After arguing at length on merits, learned counsel for the applicant states that he may be permitted to withdraw the present application with the liberty to challenge the proceedings against the applicant before the Lucknow Bench of this Court, inasmuch as, the cause of action has arisen within district Balrampur which lies jurisdiction with the Lucknow Bench.

In view of above, the present application U/s 482 Cr.P.C. is, accordingly, dismissed as withdrawn.

I may further record that other co-accused Dr. Trilochan Singh, Chief Medical Officer has also challenged the proceedings before the Lucknow Bench of this Court in Criminal Misc. Application U/s 482 Cr.P.C. No.397 of 2020 in which orders have been passed.

Office is directed to return the certified copy of the documents to learned counsel for the applicant after retaining photostat copy of the same on record.
