Heard learned counsel for the applicant, learned Additional Government Advocate for the State/opposite party No.1 and perused the record with the assistance of learned counsel for the parties.
This application under Section 482 Cr.P.C. has been filed by the applicant for quashing of the order dated 02.12.2019 passed by Judicial Magistrate, Jalaun in Case No. 2532 of 2018 (Smt. Priti vs Dilip and other), under sections 498-A, 323 IPC and section 4 of Dowry Prohibition Act, police station Orai, district Jalaun.
At the very outset learned counsel for the applicant submitted that on account of some defects, he does not want to press this application at this stage and he may be permitted to withdraw this application with liberty to file afresh at the appropriate stage.
In view of statement made by Mr. Fakhr Uz Zaman, learned counsel for the applicant at the bar, this application under section 482 Cr.P.C. is rejected as withdrawn with liberty to file afresh at the appropriate stage with better particulars.
Office is directed to return the certified copy, if any, to the learned counsel for the applicant after retaining photostat copy of the same on record as per rules.
