At the very outset, learned counsel for the petitioner submits that he may be permitted to withdraw present petition to challenge the order impugned by preferring second appeal under Section 100 of the Code of Civil Procedure, 1908 and he submits that the certified copy annexed with this petitioner may also be returned for presentation of the second appeal.
Subject to the aforesaid liberty, this writ petition is dismissed as withdrawn with direction to the registry to return the certified copy annexed with the present petition.
