Heard Sri Aditya Prasad Mishra, learned counsel for the petitioner and Sri Anwar Hussain, learned counsel for the respondents.
Sri Anwar Hussain, learned counsel for the respondents on the basis of instructions submits that the petitioner has removed the offending machinery from the residential premises. The written instructions are taken on reocrd.
Sri Aditya Prasad Mishra, learned counsel for the petitioner upon instructions from the respondents also agrees with the aforesaid submission.
In view of the fact that the petitioner has removed the offending machinery voluntarily, the cause on which the petition was founded does not survive.
The petition is dismissed.
