Heard learned counsel for the petitioner and Sri Sant Ram Sharma, learned counsel for the respondent no.3.
Petitioner is the defendant in Original Suit No.77 of 2017 filed for grant of injunction. Prayer is made to dispose of the interim injunction application pending before the court concerned.
Learned counsel for the petitioner does not dispute that no injunction has been granted to the plaintiff. No prejudice, therefore, is shown to have been caused to the defendant petitioner.
Perusal of the order sheet would go to show that the court concerned has already fixed date for framing of issues in the matter. There is no inordinate delay in disposing of the proceedings which may require any direction to expedite the proceedings. However, it goes without saying that the court concerned shall proceed to dispose of the proceedings of the aforesaid suit keeping in view the provisions contained under the Code of Civil Procedure and without granting unnecessary adjournments to either of the parties.
Subject to the above observations, this petition is consigned to records.
