Heard learned counsel for the petitioner, learned Additional Government Advocate for the State/opposite party No.1 and perused the record with the assistance of learned counsel for the parties.
This petition under Article 227 of the Constitution of India has been filed by the petitioner against the order dated 02.11.2019 passed by the learned Additional District Judge/Fast Track Court, Sonbhadra in Sessions Trial No. 96 of 2015 (State vs Shyam Lal Yadav and another) arising out of Case Crime No. 312 of 2015, under section 302/201 IPC, police station Chopan, district Sonbhadra, whereby the application No. 43 Kha under section 311 Cr.P.C. of the accused-petitioner has been rejected.
At the very outset learned counsel for the petitioner submitted that on account of some defects, he does not want to press this petition and he may be permitted to withdraw this petition with liberty to file Application u/s 482 Cr.P.C. afresh with better particulars.
In view of statement made at bar by Mr. Satya Prakash Shukla, learned counsel for the petitioner, this petition is dismissed as withdrawn with aforesaid liberty.
Office is directed to return the certified copy, if any, to the learned counsel for the petitioner after retaining photostat copy of the same on record as per rules.
