Heard Shri Ashok Mehta, learned Senior Advocate assisted by Shri Amit Mahajan, learned counsel for the petitioner and Shri Ashish Agrawal and Shri P.P. Srivastava, learned counsel for the respondents.
It is the contention of the learned senior counsel appearing for the petitioner that the impugned revisional order has been passed without taking into consideration the contentions as raised by the petitioner with regard to its income on unsecured loans etc. He further argues that all the evidences that was required to be considered is already there before the revisional authority, but he did not go into it.
Instructions have come from the department. However, in order to put a closure to the matter and in the best interest of justice we allow the petitioner to file his written contentions within a week from today before the revisional authority.
A date is being fixed i.e. 05.04.2019 for hearing of the matter before the revisional authority in the presence of both the parties. The revisional authority may pass a fresh orders in accordance with law, after giving an opportunity of hearing to the petitioner
It is made clear that no adjournment shall be granted on that date, unless there is an urgent and justified need to do so.
With the aforesaid observations, the writ petition stands disposed of.
