Heard learned counsel for the petitioner and Sri Siddharth Singh, learned Additional Chief Standing Counsel for the State.
The petitioner in the present writ petition has come up with a prayer for writ of mandamus directing the respondent no.2 to decide the application dated 14.01.2019 filed by the petitioner before the respondent no.2 for grant of arm license.
According to the petitioner, he has applied for arm license on 14.01.2019 and under Section 17 of Arms Act, the licensing authority is supposed to take a decision on the application of the petitioner within 60 days but more than 60 days had expired but the respondent no.2 has not yet taken decision on the said application.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending.
Considering the facts and circumstances of the case and with the consent of the parties, without adverting into merits of the case, the writ petition is disposed off with the direction to the respondent no.2 i.e. District Magistrate, Etah to decide the application dated 14.01.2019 filed by the petitioner (Annexure1 to the writ petition) for grant of arm license, expeditiously, preferably within a period of four months from the date of production of certified copy of this order.
