Heard Sri Jata Shankar Pandey, learned Counsel for the petitioner and Sri Ratnesh Srivastava, learned Counsel for respondent-Bank.
Petitioner has challenged the recovery certificate dated 26.11.2018 on the ground that the State Government in the year 2017 has issued a Loan Waiver Scheme and the petitioner is a small and marginal farmer is entitled to relief up to Rs.1,00,000/-.
Learned Counsel for the petitioner contends that he is not pressing his relief as far as the recovery certificate is concerned and his sole prayer is that respondent no.2 may be directed to decide his loan waiver application which he proposes to file within 15 days from today.
In view of the above, if the petitioner files an application for loan waiver under the Scheme of 2017, respondent no.2 shall consider the same and pass reasoned and speaking order as expeditiously as possible.
Writ petition stands disposed of.
