The petitioner claims that he is the owner and bhumidhar of Plot No.46, area 1.4880 hectare situated in village Mahapur, Tahsil Kerakat, District Jaunpur. The grievance of the petitioner is that the authorities concerned is constructed a chak road over the land of the petitioner without adopting any acquisition proceedings.

Learned counsel for the petitioner submits that the action of the respondents is violation of his constitutional right under Article 300-A of the Constitution, as neither the land of the petitioner has been acquired under the law nor any compensation has been paid to him.

From the record, we find that for redressal of his grievance, the petitioner has made representations dated 05.12.2018 and 14.12.2018, which he has placed on record as Annexure-6 to the writ petition.

We have heard counsel for the parties and perused the record.

¶9

Taking into consideration the entire facts and circumstances, we are of the view that ends of justice requires that a direction be issued upon the second respondent to consider the cause of the petitioner and pass the appropriate order in accordance with law. We grant liberty to the petitioner to make a fresh representation before the District Magistrate along with certified copy of this order.

With the aforesaid direction, the writ petition is disposed of.
