Civil Misc. Withdrawal Application no.2 of 2019 dated 8.4.2019 supported by affidavit is taken up.
The prayer in the application is that the petitioner may be permitted to withdraw the writ petition and the same may be dismissed as withdrawn.
The writ petition was filed seeking following relief:-
"(i) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent No. 2 to decide the claim of the petitioner regarding to the report dated 26.12.2017 (Annexure No.2), submitted by the Sub-Divisional Magistrate, Dataganj, District Budaun, which is pending before him.
(ii) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents authority to restrain the interference over the land in question / Gram Samaj land, situated in Gram Panchayat- Beladandi, Block-Dataganj, Tehsil-Dataganj, District-Budaun.
(iii) Issue any other writ, order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the case.
(iv) To award cost of the petition to the petitioner."
We, therefore, allow the withdrawal application and dismiss the writ petition as withdrawn.
Interim order, if any, stands vacated.
