Heard Sri Chandra Shekhar Agnihotri, learned counsel for the petitioner, Sri Ashwani Mishra, learned counsel for the respondent no.2 and learned Standing Counsel for the respondent no.1.

The petitioner in the writ petition is seeking a direction to the respondent no.2 to handover to the petitioner the peaceful vacant possession of alternative Plot No. 316, Block HNS Yojana-I, Factory Area, Kanpur Nagar ad measuring 466 square yards.

We find from the letter dated 11.3.2016, Annexure-5 to the writ petition that there is a direction by the Assistant Accountant (Zone-2) Kanpur Development Authority that mutation of name in favour of the petitioner in respect of plot no. 316 has already been ordered. The petitioner has also submitted a representation before the Vice Chairman, Kanpur Development Authority on 11.1.2018, copy of which has been filed as Annexure -8 to the writ petition.

No useful purpose would be served in keeping the writ petition pending.

We, therefore, dispose of this writ petition with a direction to the Respondent no.2-Vice Chairman, Kanpur Development Authority, Kanpur to decide the petitioner's representation dated 11.01.2018 taking into consideration the letter dated 11.3.2016, Annexure-5 to the writ petition, expeditiously, preferably within a period of three months from the date of receipt of a certified copy of this order in his office.

Alongwith the certified copy of the order the petitioner shall submit a copy of the representation dated 1101.2018 to the respondent no.2.

It is made clear that the Court has not adjudicated the claim of the petitioner on merit.
