This writ petition has been filed for the following relief:-

"Issue a writ, order or direction in the nature of mandamus commanding & directing to the respondent authorities to issue the passport in favour of the petitioner within an early date, which is interrupted by the respondent authorities on the basis of criminal cases."

Learned counsel for the petitioner submitted that the petitioner has applied, for issuance of passport, before the Regional Passport Office, Lucknow (respondent no. 2), but the same is not being issued only on the basis of the police report submitted regarding pendency of a criminal case against him, which is under trial.

Learned counsel for the respondent no. 1 submits that a show cause notice dated 10.10.2018 has already been issued to the petitioner by the Regional Passport Office, Lucknow requiring him to submit his explanation within 30 days, but till date the petitioner has not appeared in person before the authority concerned nor he has filed any reply.

Learned counsel for the petitioner submitted that the petitioner has not been served with any notice as stated by the learned counsel for the respondents.

Learned counsel for the respondent no. 1 has served a copy of the notice dated 10.10.2018 to the learned counsel for the petitioner today in the Court.

Heard learned counsel for the parties and perused the records.

Considering the facts and circumstances of the case, we direct that the petitioner may file his reply to the notice dated 10.10.2018 within 15 days from today in the office

of Regional Passport Office, Lucknow between 10.30 am to 1.30 p.m. on any working day, as referred in the notice dated 10.10.2018. In case the reply is filed, the same shall be considered and disposed of by the authority concerned within a period of 30 days thereafter.

It is made clear that in case the reply to the show cause notice dated 10.10.2018 is not filed by the petitioner within the time specified by this Court, the benefit granted under this order shall automatically be ceased to operate.

With the above observation/direction, the present writ petition is disposed of.
