This writ petition has been filed, inter alia, for the following relief;
"(i) Issue a writ order or direction in the nature of mandamus directing the respondents not to interfere in peaceful possession and renovation by the petitioner over 7 biswa land of Gata No. 1216m situate in Village Naya Gaon, Tehsil Sikandrabad District Bulandshahar in compliance of the order dated 9.6.2017 passed by the respondent no. 2.
(ii) Issue a writ order or direction in the nature of mandamus directing the respondent no. 3 to decide the application of the petitioner dated 20.6.2019 in accordance with law within the time stipulated by this Hon'ble Court, otherwise; the petitioner shall suffer an irreparable loss and injury."
Heard learned counsel for the parties and perused the record.
Learned counsel for the petitioner submitted that despite an order dated 9.6.2017 having been passed by the Additional Commissioner, Meerut Division Meerut, Respondent No. 2 in favour of the petitioner to the effect that authorities concerned shall not cause any interference in the peaceful construction over the premises in question, interference is being caused in the peaceful construction and possession of the petitioner over the premises in dispute with the
collusion with revenue officers.
Be that as it may, it is open for the petitioner to approach the Respondent No. 2, Additional Commissioner, Meerut Division Meerut/concerned authority for redressal of his grievances. In case, the petitioner files an appropriate application ventilating his grievances within a period of two weeks from today before the Respondent No. 2, Additional Commissioner, Meerut Division Meerut/concerned authority, the Respondent No. 2, Additional Commissioner, Meerut Division Meerut/concerned authority shall pass appropriate order and do the needful in the matter in accordance with law. The Respondent No. 2, Additional Commissioner, Meerut Division Meerut/concerned authority shall further ensure that the order dated 9.6.2017 is complied with provided there is no legal impediment.
With this observation, this writ petition stands finally disposed of.
