Heard Shri Radha Kant Ojha, learned Senior Counsel assisted by Shri Sanjay Srivastava, learned counsel for the petitioner, learned Standing Counsel for the respondent No.1 and Shri Rohit Pandey, learned counsel for the respondent Nos.2 to 4.

Present Writ Petition under Article 226 of the Constitution of India has been filed for issuance of a writ of mandamus commanding the respondent Nos.2 to 5 to permit the petitioner to appear in the examination of LL.B. 6th Semester 2018-2019 along with one back paper of 1st Semester.

The contention of learned counsel for the petitioner is that the petitioner was declared unsuccessful in the 1st Semester and permitted to appear in the one back paper of 1st Semester i.e. Law of Contract along with 6th Semester examination. Learned counsel for the petitioner further submits that the petitioner is ready to appear in the 1st Semester back paper as well as 6th Semester examination of LL.B. three years course and necessary direction be issued to the University in this regard. It is further contended by learned counsel for the petitioner that the representation in this regard has been filed by the petitioner on 27.11.2019 to the Examination Controller, Chhatrapati Shahuji Mahraj University, Kanpur, respondent No.4, which is appended as Annexure-5 to the Writ Petition.

Shri Rohit Pandey, learned counsel for the respondent Nos.2 to 4 has no objection in case direction be issued for deciding the said representation as it has not yet been decided.

Under the facts and circumstances of the case, direction is issued to the Examination Controller, Chhatrapati Shahuji Mahraj University, Kanpur, respondent No.4 to take decision on the petitioner's representation dated 27.11.2019 as expeditiously as possible, preferably within a period of two weeks from the date of production of a certified copy of this order before him.

With the aforesaid direction, Writ Petition stands disposed of.
