Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
In view of the order proposed to be passed, notices need not to be issued to respondent Nos.3 and 4.
This writ petition has been filed with the following prayers:-
"(I) Issue a writ, order or direction in the nature of mandamus commanding the respondent No.3 to pay the compensation to the petitioner.
(II) Issue a writ, order or direction in the nature of mandamus commanding the respondent No.3 to decide the representation of the compensation dated 09.02.2018."
It appears from perusal of the averments made in the writ petition, it appears that the petitioner is farmer and lost his son in a road accident. He moved an application for being awarded compensation to the tune of Rs.75,000/- before respondent No.3 under the scheme of Uttar Pradesh Mukhyamantri Kisan Evam Sarvhit Bima Yojana on 09.02.2018 (Annexure No.6 to the writ petition) but the said application has not been decided till date. It is contended by the counsel for the petitioner that a suitable direction may be issued to respondent No.3 to decide the application filed by the petitioner before him (Annexure No.6 to the writ petition) for grant of compensation for the death of petitioner's son in a road accident within a specified period.
Having heard the learned counsel for the parties and without expressing any opinion on the merits of the case, we disposed of this writ petition with the direction to respondent No.3 to decide the representation dated 09.02.2018 (Annexure No.6 to the writ petition) filed by the petitioner before him under the scheme of Uttar Pradesh Mukhyamantri Kisan Evam Sarvhit Bima Yojana strictly in accordance with law by a speaking and reasoned within a period of two months from the date of production of certified copy of this order.
