Heard Sri P.K. Kashyap, Advocate holding brief of Sri Ravindra Pal Singh, learned counsel for petitioner and learned Standing Counsel for respondents-1 to 4.

This writ petition under Article 226 of Constitution of India has been filed for mandamus directing respondent no.2, District Magistrate, Budaun to conduct fair enquiry against respondent no.5 regarding embezzlement of Village Panchyat fund and further to decide representation dated 16.20.2019 filed by petitioner.

Peerusal of record shows that petitioner has made a complaint to respondent no.2, District Magistrate, Budaun regarding irregularity committed by respondent no.5 Naresh Pal, Gram Panchayat Adhikari of Gram Panchayat, Ajeetpur, Development Block, Asafpur, Tehsil Bisauli, District Budaun but no enquiry has been made by District Magistrate.

Perusal of record shows that respondent no.2, District Magistrate, Budaun has passed order dated 26.11.2018 directing the Deputy Director of Agriculture, Budaun/Nodal Officer, Asafpur and Block Development Officer, Asafpur, Budaun to conduct an enquiry on complaints made against Naresh Pal Singh, Gram Panchayat Adhikari, Gram Panchayat, Asafpur.

Considering the fact that complaint made against respondent no.5 is regarding illegalities/irregularities committed by him in relation to beneficial scheme launched by State Government, we accordingly direct respondnet no.2, Distric Magistrate, Budaun to bring the enquiry proceedings initiated against respondent no.5 to its logical conclusion within a period of two months from the date of production of certified copy of this order before him.

With the aforesaid direction, this petition stands finally disposed of.
