Heard learned counsel for the parties.

In view of the order proposed to be passed, notices need not to be issued to the private respondent.

The petitioner is before this Court for a direction to respondent no.2/Sub Divisional Magistrate, Kampierganj, District District Gorakhpur to decide the Restoration Application No.RST/00643 of 2019/Computerized Case No.T201905310400643 filed in the Suit No.103 of 2003 (Phoola Devi Vs. Ramkawal) under Section 229-B of U.P. Zamindari Abolition and Land Reforms Act, 1950 expeditiously within a stipulated period.

Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the petition stands disposed of finally with a direction to the respondent no.2/Sub Divisional Magistrate, Kampierganj, District Gorakhpur to consider and decide the aforesaid restoration application in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order but certainly after giving opportunity of hearing to the parties concerned without granting unnecessary adjournment to either of the parties, except upon payment of cost.
