Learned counsel for the petitioner submitted that he has a land on the bank of a river and after flood certain minerals such as sands has been left out over on the land of the petitioner and under Rule 52-A of the U.P. Minor Minerals (Concession) Rules, 1963, he has already made an application for removal of such a minerals after deposit of Rs.2,000/-. The said application has remained pending and has not been yet decided.
The writ petition is disposed of with the direction to District Magistrate, Banda to consider the application of the petitioner and pass appropriate orders in accordance with law as far as possible within two months from the date a certified copy of this order is presented.
