Heard learned counsel for the petitioner and Sri Manoj Nigam who has accepted notice on behalf of respondent No.3.

The petitioner has challenged the recovery citation dated 18.09.2019 whereby the bank dues of Rs. 3,46,900/- plus interest are being recovered from the petitioner.

The submission of counsel for the petitioner is that the petitioner is ready and willing to pay the entire amount provided some reasonable time is allowed by this Court and installments are fixed.

Counsel for the bank is also more interested in getting the amount cleared rather than prolonging the recovery proceedings.

In view of the aforesaid facts and circumstances, we dispose off the writ petition with the direction to the petitioner to deposit a sum of Rs. 1,46,900/- by 15th December, 2019 and the balance amount of Rs. 2,00,000/- in four installments of Rs. 50,000/each to be payable in the months of January, 2020, February, 2020, March, 2020 and April, 2020. The last installment will include all the interest and miscellaneous charges, if any that may accrue on the outstanding amount in the meantime.

In the event of default in payment of any of the installments as fixed above, the benefit of this order would come to an end automatically.

The writ petition stands disposed off accordingly.
